Legal Fireside Chat: Federal WARN and NJ WARN in Light of the Coronavirus Pandemic

September 17, 2020

Virtual Event

Price: $10 SHRM Foundation Donation

Facing the many challenges posed by the COVID-19 pandemic, New Jersey employers are considering their obligations to their workforce in the event of a reduction in force.  If they’re considering layoffs, it’s imperative for employers to understand the Worker Adjustment and Retraining Notification (WARN) requirements for issuing notice to their employees.  Fisher Philips attorneys Alvaro Hasani and Alyssa Musmanno will provide Morris County SHRM members an overview on how the Federal and NJ Warn Act may affect companies during the pandemic, provide insight on employers’ obligations and outline critical steps to carefully avoid or mitigate the risk of litigation.

Learning Outcomes:

  *   Discuss companies with furloughed employees and their future obligations under the Federal and NJ WARN Acts
  *   Discuss potential exceptions to the Federal and NJ WARN Acts
  *   Understand the guidance provided by the Federal Department of Labor regarding COVID-19 and the Federal WARN Act
  *   Discuss penalties for non-compliance with notice requirements under the Federal and NJ WARN Acts

Speakers:

Alvaro Hasani, Associate, New Jersey Office:
Alvaro Hasani is an associate in the firm's New Jersey and New York offices. He represents employers in various industries and in all aspects of labor and employment law before federal and state courts, as well as regulatory and administrative agencies.

Alvaro has a successful track record defending clients in individual, class, and collective actions on a wide range of issues, including discrimination, harassment, retaliation, wrongful discharge, wage and hour claims, whistleblower claims, non-compete, and other business-related disputes. He has also obtained favorable decisions on behalf of clients before governmental agencies including the U.S. Equal Employment Opportunity Commission, NJ Division on Civil Rights, NJ Department of Labor and Workforce Development, NJ Department of Community Affairs, NY State Department of Labor, and NYC Commission on Human Rights.

Alyssa Musmanno, Associate, New Jersey Office:

Alyssa Musmanno is a labor and employment litigation attorney in the firm’s New Jersey office. Alyssa joined Fisher Phillips in 2019 after practicing with a New Jersey based law firm representing clients in connection with commercial disputes.  She has worked on litigations at the trial court level involving contract disputes.

Alyssa clerked for the Honorable Douglas M Fasciale in the Appellate Division of New Jersey.  While in law school, she served as a legal intern for the Honorable Patty Shwartz in the United States Court of Appeals for the Third Circuit and the Honorable Rosemary Ramsay in the New Jersey Superior Court’s Civil Division.
