This presentation offers attendees an in-depth, practical examination of the Occupational Safety and Health Act (the “Act”) and how it, and the Secretary of Labor’s right to enforce the Act, may potentially affect his or her business. Attendees will be provided a thorough analysis of the Act, including its history and purpose, the type of citations, penalties that may be issued under the Act, and a step-by-step discussion of the legal process implicated when a citation is issued.

Attendees will be provided “real world” information regarding the various legal aspects of the Act, including references to actual scenarios under which citations under the Act have been issued. Education regarding the Secretary of Labor’s right to issue citations will be a focus; attendees will learn the ramifications that may result from the payment of citations even after settlement negotiations with the Secretary of Labor have taken place.

Travis W. Vance – Partner, Fisher Phillips (Charlotte, NC)
Travis Vance is a partner in Fisher Phillips’ Charlotte office. He has tried matters across several industries and various subject matters, including employment litigation, business disputes and matters prosecuted by the Mine Safety and Health Administration (MSHA) and Occupational Safety and Health Administration (OSHA). He uses unique or outside-the-box approaches to counsel employers and owners on all aspects of employment law and the development of preventive policies and procedures to avoid employment and workplace safety-related claims. Travis handles litigation in both federal and state courts as well as claims pending with state and federal agencies including the Equal Employment Opportunity Commission (EEOC), MSHA, OSHA, and the U.S. Department of Labor (USDOL).
